Inpix - Privacy Policy

1. General

Inshorts India Advertising and Services Private Limited having its registered office at 713, 7^th floor, Devika Tower 6, Nehru Place, New Delhi - 110019, India and corporate address at Plot No. 1, 4th Floor, Sector 16 A, Noida, Uttar Pradesh 201301, India (“We”, “Our”, “Us”, “Inshorts India”) is committed to the protection of information provided by user (“You”, “Your”, “User”) to Us on the Inpix mobile application (“App”), which personally identifies You (“Personal Information”). You affirm that Your usage of the App shall constitute Your consent to collecting, receiving, possessing, storing, dealing, sharing or handling of Your Personal Information in accordance with the terms outlined in this Privacy Policy (“Privacy Policy”).

This Privacy Policy applies to all Users who access the App and are therefore required to read and understand the Privacy Policy before submitting any Personal Information.

This Privacy Policy explains how We collect, use, disclose, and safeguard Your information when You access or use Our App. Our App provides You access to an extensive library of content, including but not limited to images, videos, graphics, templates, fonts, and other design assets, collectively referred to as  “Content” (defined as such in the Terms). Content can be used by incorporating Your name, photograph, or other identifying elements to create personalized digital or printed materials, including but not limited to greeting cards, invitation cards, posters, banners, advertisements, promotional materials, branding assets, marketing collateral, public relations (PR) materials, entertainment content, political campaign materials, or any other creative work, collectively referred to as “Creative(s)” (defined as such in the Terms). Additionally, our App may display third-party advertisements, and this policy also explains how advertising partners collect and process Your data.

We prioritize the privacy of Our Users and are dedicated to protecting their personal information while delivering a customized and meaningful experience.

Your access to the App, Creatives and Content available through the App is subject to your acceptance of this Privacy Policy, which supplements the Terms and Conditions of Use (“Terms”). Any undefined term in this Privacy Policy shall have the same meaning as stated in the Terms. You agree that this Privacy Policy, along with our Terms, constitutes the agreement governing Your use of the App.

2. Information Collected

We collect different types of information to enhance and deliver Our services effectively.

a) The following information is provided by You, while registering Your account on the App:

● Your name;

● Your clear and identifiable photograph;

● Your phone number;

● Your payment information: To subscribe to Our available plans, You must provide Your billing details and preferred method of payment at the time of purchase. We may also collect and store Your transaction history;

● Creatives: The Creatives you create using the Content within the App.

b) Information collected automatically: 

● Device Information: We collect data including device type, unique device identifiers, operating system, location, and IP address.

● Usage Data: We track how You interact with the App, such as Content viewed, used, accessed, Creatives created, Your preferences, time spent, and engagement with different features offered through the App.

● Cookies & Tracking Technologies: We utilise cookies, web beacons, location, IP address and similar tools to improve Users’ experience, analyse usage patterns, and customize advertisement & Content recommendations.

c) Information from Third-Party Sources

● Third-party integrations: If You connect your App account with external services (such as Google, Facebook, or Apple), we may receive information from these platforms.

● Advertising & Analytics: Our advertising partners and analytics providers may share information with Us for targeted advertising and performance tracking.

3. Usage Of Personal Information

a) The information We collect from You is used to optimise the presentation of  the App, to fulfil Our commitments to You, and to effectively facilitate Our communication with You.

b) Rest assured that We make every effort to use information in aggregated form to ensure  that no individual user is identified. However, this is to apprise You that We may use Your Personal Information for the following purposes which shall collectively constitute “Permitted Use”):

● Account Registration & Identity Verification: To create and maintain Your account on the App, We collect and process certain Personal Information (PI) for authentication and security purposes. This includes verifying Your identity through One-Time Password (OTP) authentication and other verification measures to prevent unauthorized access and ensure the integrity of Our platform.

● Legal & Regulatory Compliance: We retain and disclose information as required by law, to respond to regulatory or law enforcement requests, and to enforce Our Terms to maintain a secure digital environment.

● Security & Fraud Prevention: We monitor activity for suspicious behaviour, enforce encryption and authentication measures, and prevent unauthorized access, piracy, or fraudulent transactions.

● Payment Processing: We securely handle payments for subscriptions and purchases, store billing details when necessary, and collaborate with third-party payment providers for seamless transactions.

● Service Enhancement: We analyze Users’ preferences, viewing history, and interactions to recommend relevant features, and to optimize App performance.

● User Experience Optimization: We personalize Content and Creative suggestions, refine navigation, and incorporate User feedback to create a more intuitive, engaging, and seamless experience of the App.

● Research & Analytics: We assess User engagement, User demographics, and App performance to refine recommendations, enhance algorithms, and develop new features based on audience insights.

● Usage Auditing: We monitor User interactions, Creative & Content usage, and account activity to assess service performance, prevent misuse, and ensure compliance with policies.

● User Communication: We provide account updates, respond to inquiries, share promotional offers, and notify Users about new Content, features, or policy changes.

● Marketing Profiles: We analyze User behavior, preferences, and engagement to create targeted marketing strategies for personalized promotions and Creative & Content recommendations.

● Advertising & Sponsorships: We collaborate with advertising partners to deliver personalized ads, track advertisements’ performance, and manage sponsorships while ensuring relevant promotions for Users.

4. Disclosure Of Personal Information

a) We do not reveal Your Personal Information to third parties except to Inshorts India’s affiliates, trusted business partners, or third party service providers  or persons, and such disclosure is done under a lawful contract and in accordance with Our Privacy Policy, along with necessary confidentiality and security safeguards in place.

b) User information is never sold to any third party.

c) We may transfer any and all Personal Information to the relevant third party while maintaining the same rights in relation to access and use thereof, in the event of a merger, demerger, business reorganization, joint venture, acquisition, assignment, spin-off, transfer, sales of assets, or sale or disposition of all or any portion of Our business, including in relation to any bankruptcy or similar proceedings.

d) Except as otherwise provided in this Privacy Policy, We will keep Your Personal Information confidential and will not disclose it to third parties, unless We believe in good faith that disclosure of Your Personal Information or any other information collected by Us is required for Permitted Use, as defined above, or to:

● Enforce the Privacy Policy, including Terms;

● To ensure compliance with a court order or pursuant to initiation of other legal proceeding;

● Protect the rights, property or safety of Inshorts India or another party; or

● Respond to claims that any Creative or Content violates the rights of any third party.

e) By accepting this Privacy Policy, You hereby consent to sharing Your information, including Your Personal Information, with third parties for the Permitted Uses, and in accordance with this clause of the Privacy Policy.

5. Security

a) The security of Your Personal Information is Our priority. We implement appropriate security measures in accordance with applicable laws and commercially reasonable standards including physical, operational, managerial, and technical security safeguards. These safeguards are designed to protect Your Personal Information from unauthorized access, alteration, disclosure, loss, misuse, or destruction. These measures vary based on the type and sensitivity of the data We collect and store.

b) While We strive to store Your Personal Information in a secure environment, inaccessible to the public, You must understand that We cannot guarantee that unintended disclosures of Your Personal Information will never occur. However, if We become aware of any disclosure of  Your Personal Information not in accordance with this Privacy Policy, We will use reasonable efforts to inform You of the nature and extent of such disclosure (to the extent known to Us) as soon as reasonably possible, and as permissible by law. You should not share Your account details or OTP with any third party, and if You believe Your  account has been compromised, You should change it immediately and contact Us at inpix@inshorts.com.

c) We uphold a high standard of security for Our users. However, the transmission of data via the internet or telephone networks is not entirely secure. While We do Our best to protect Your information, particularly with respect to protection of Your personal data, however, We cannot ensure the security of Your data transmitted via the internet, telephone or any other networks.

6. Data Retention

a) Legal and Regulatory Purposes: We retain your personal data for the duration necessary to deliver our services, meet contractual commitments, and adhere to relevant legal, regulatory, tax, accounting, or security obligations. The retention period varies based on the type of data, its intended purpose, and any applicable laws or industry standards.

b) Deletion of Your data & Exceptions:  If you request to delete your information, We will make reasonable efforts to remove Your personal information from active databases. However, certain data may be retained to comply with legal requirements, prevent fraud, resolve disputes, enforce Our agreements, maintain security, or fulfil other legitimate business needs. This may include backup copies, transaction records, or logs required for auditing, security, or regulatory compliance.

c) Research & Analytics Purposes: Additionally, We may retain data, either in identifiable or anonymized form, for purposes such as research, archiving, statistical analysis, business intelligence, or any other lawful activities, provided such retention complies with relevant legal and regulatory requirements. Once the retention period ends, We ensure secure deletion or anonymization to prevent any association with You.

7. Privacy of Children

As mentioned in the Terms, Our App is not designed for individuals below the legal age of majority in their respective jurisdiction. We do not intentionally collect personal data from minors. If We discover that such information has been collected, We will take appropriate measures to delete it.

8. Third-Party Links & Services

Our App may include links to third-party websites or services. We do not control their privacy practices and recommend that You review their policies independently.

9. Updates And Changes To Privacy Policy

We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy. If We do, then We will post these changes on this page and will inform you when we make material changes. If You continue to use the App subsequent to the posting of modifications to this Privacy Policy, Your consent and acceptance of Our changes will be construed as such.

10. Your Rights 

a) You are entitled to review Your Personal Information available with Us, and rectify any errors therein from the “Edit Profile” section on the App or by sending an email to Us at inpix@inshorts.com.  

b) You may raise a request to Us in writing asking Us to cease usage of Your Personal Information and/or to delete Your existing Personal Information, at inpix@inshorts.com. In the event of Your refusal to share any information, or withdrawal of Your consent to process information that You have previously provided to Us, We reserve the right to restrict or deny the provision of Our services for which We consider such information to be necessary.

11. Restriction Of Liability

a) Disclaimer of liability: We make no claims, promises or guarantees about the accuracy, completeness, or adequacy  of the Creative & Content available through the App and expressly disclaim liability for errors and omissions in the Creative & Content available through the App.

b) Disclaimer of Warranty: No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third-party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the Creative & Content available through the App or its links to other internet resources as may be available to You through the App.

c) No endorsement: Reference in the App to any specific commercial products, processes, or services, or the use of any trade, firm or corporation name or name of any political party or politician or any such entity is for the information and convenience of the public, and does not constitute endorsement, recommendation, or favouring by Us.
